1. Scope and Who We Are
This Policy covers personal information used for website visits, waitlists, surveys, paid reservations, orders, benefits, refunds, and advertising. Necessary transaction processing is separate from optional marketing and advertising choices.
This Privacy Policy explains how KIWII AI INC. ("Kiwii," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit kiwii.ai, www.kiwii.ai, move.kiwii.ai, launch.kiwii.ai and related Kiwii product landing pages, join a waitlist, make or redeem a paid reservation, place an order, request a refund, complete a survey, communicate with us, or interact with our advertising (collectively, the "Service"). It covers website transaction information; separate App privacy notices govern App-specific data practices.
KIWII AI INC. is a Delaware corporation. Privacy questions and requests may be sent to marketing@kiwii.ai or mailed to KIWII AI INC., 4521 Campus Drive, Ste 292, Irvine, CA 92612, United States.
The Service is intended for people located in the United States. Capitalized terms not defined in this Privacy Policy have the same meaning as in our Website Terms of Use, our Returns & Refunds policy, and our Limited Warranty policy.
2. Personal Information We Collect
Information You Provide
- Contact information. Your email address, name, and other information you include when you contact us. We collect billing or shipping contact details and an address when needed for payment, tax, product delivery, rather than requiring a shipping address merely to join a waitlist.
- Waitlist information. Your email address, landing-page segment, referral source, and information associated with your request for launch updates or early access.
- Survey information. Voluntary responses about age range, gender, routines, activity level, product interests, wellness goals, purchase preferences, and free-text feedback.
- Communications. Messages, requests, feedback, and records of our responses.
Reservation and commercial information. The eligible product or variant, campaign and promotional benefit, reservation and order identifiers, amount and currency paid, principal and promotional-discount amounts, itemized taxes and other charges collected at each payment stage, reconciliation of prior payments, redemption status, order status, refund amount and status, and dispute or chargeback records.
Payment and verification information. Payment-provider transaction references, payment status and method descriptors, and billing or verification details needed to process a transaction. The payment information collected and recipients depend on the payment flow shown at checkout. Do not send full card numbers or security codes by email. We do not use payment credentials for advertising.
Choice and agreement records. The time and version of Terms, Campaign Schedule and notices presented, your affirmative checkout acceptance, and separate marketing and privacy choices. These records document the transaction and help us honor your choices.
Information Collected Automatically
- Device and network information. IP address, browser and device type, operating system, language, approximate location derived from IP address, and similar technical information.
- Usage information. Pages viewed, links and buttons selected, referring page, timestamps, campaign parameters, click identifiers, and events such as PageView and Lead.
- Cookies and similar technologies. Cookie identifiers, local storage, pixels, tags, and similar technologies used for site operation, measurement, fraud prevention, and advertising.
- Advertising information. Information associated with our advertisements on Meta and, when enabled, Google, including ad interactions, attribution data, audience membership, and conversion events.
Wellness-Related Information
Some voluntary survey responses may reveal wellness interests or permit health-related inferences. We do not request medical records, diagnoses, medication histories, genetic information, or information for medical treatment. We do not use survey responses to make decisions about health care, insurance, employment, credit, housing, or access to essential services, and we do not upload individual survey answers to Meta or Google to create personalized advertising audiences. Reservation, payment, or marketing consent does not authorize separate collection or sharing of consumer health data. Where applicable law requires a separate consumer health data notice or consent, we provide it before that processing. Health-related survey data is not necessary to obtain a reservation benefit or refund.
3. Sources of Personal Information
We collect personal information directly from you, automatically from your browser or device, from payment and fraud-prevention providers, from delivery providers when fulfillment occurs, and from advertising, analytics, and other service providers. Transaction sources include your checkout choices and requests, payment-provider confirmations and refund or dispute updates, and our records of the terms and notices presented. We may also receive aggregate campaign information from Meta or Google concerning our own advertising accounts.
4. How We Use Personal Information
- Operate, secure, troubleshoot, and improve the Service.
- Manage waitlists and communicate about Kiwii product availability, pricing, testing, launch, and related updates in accordance with your marketing choices.
- Analyze survey responses and product interest to guide product and marketing decisions.
- Measure advertising performance, attribute conversions, prevent duplicate event reporting, and create or manage advertising audiences as permitted by law and your choices.
- Respond to questions, privacy requests, and support inquiries.
- Detect fraud, abuse, security incidents, and violations of our Website Terms of Use.
- Comply with law, enforce our rights, and establish or defend legal claims.
Administer reservations, apply the selected promotional benefit, verify and reconcile payments, send transaction and delay notices, process cancellations and refunds, resolve disputes, and fulfill orders using only the information reasonably needed for those purposes.
Document consent and terms versions, maintain required transaction records, and investigate fraud proportionately. Necessary transaction processing is separate from optional marketing and advertising; paying a deposit is not advertising consent.
5. How We Disclose Personal Information
We disclose personal information only as reasonably necessary for the purposes described in this Policy, including to the following categories of recipients:
- Hosting and infrastructure providers. Vercel and providers that host or secure the Service.
- Email and waitlist providers. Klaviyo and related providers that manage subscriptions, lists, and email delivery.
- Productivity and data-storage providers. Google Workspace, Google Sheets, Google Apps Script, and related tools used to receive and store waitlist or survey information.
- Advertising and measurement partners. Meta Platforms and, when enabled, Google Ads or Google Analytics, for advertising delivery, attribution, conversion measurement, audience management, and campaign reporting.
Payment and fraud-prevention providers. Providers involved in authorizing, processing, reconciling, refunding, and securing payments, and financial institutions or payment networks involved in disputes. They receive the transaction, billing, identifier, and verification information needed for those tasks. The provider and its role are identified in the payment flow before you submit payment information.
Order and delivery providers. Where fulfillment occurs, providers handling products receive necessary order details and delivery contact information. Customer-support providers may receive relevant reservation, order, and refund information to resolve your request. These disclosures do not authorize recipients to use sensitive payment or health data for advertising.
- Professional advisers. Lawyers, accountants, auditors, insurers, and consultants subject to appropriate confidentiality obligations.
- Authorities and legal recipients. Government agencies, courts, counterparties, or others when required by law or reasonably necessary to protect rights and safety.
- Corporate transaction recipients. Parties involved in a financing, merger, acquisition, reorganization, bankruptcy, or sale of assets, subject to appropriate safeguards.
6. Sale, Sharing, and Targeted Advertising
We do not sell personal information for money. When advertising technologies are active, our disclosure of identifiers and internet or device activity to Meta or Google for cross-context behavioral advertising, audience creation, or targeted advertising may be considered a "sale," "sharing," or processing for "targeted advertising" under certain U.S. state privacy laws, even when no money is exchanged.
You may change optional analytics and advertising choices through Privacy Choices at kiwii.ai/privacy#privacy-choices or contact marketing@kiwii.ai to request an advertising opt-out. We will treat a legally valid Global Privacy Control signal as a request to opt out where required. We do not require you to create an account to submit an opt-out request. Payment does not constitute consent to advertising or the sale or sharing of personal information.
We do not knowingly sell or share personal information of anyone under 18 for targeted advertising.
8. Marketing Communications
You may unsubscribe from marketing emails at any time by using the unsubscribe link in an email or contacting marketing@kiwii.ai. The free Kiwii Move launch-updates signup offers one marketing email a month. Marketing signup is optional and separate from a paid reservation. We may still send non-marketing messages needed to confirm a reservation or payment, send the December balance-payment invitation and explain redemption or delays, fulfill an order, address fraud or disputes, process refunds, or administer privacy choices. Unsubscribing does not cancel your reservation, prevent a refund, or remove your privacy rights.
9. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy. Contact and waitlist information is retained according to the subscription and product-research cycle. Reservation, benefit, payment, refund, and dispute records are retained to administer the transaction and for applicable accounting, tax, fraud-prevention, and legal-claim periods. Consent and policy-version records are retained as needed to document the choices and terms governing the relevant processing or transaction. Delivery details are retained only as needed for fulfillment, returns, support, and applicable legal requirements. Security logs follow a limited security and investigation period. We assess each category against its purpose and applicable obligations; a purchase does not justify keeping all of your information indefinitely. We delete or de-identify information when no longer necessary and restrict any information retained under a legal exception to that purpose, including through applicable backup deletion cycles.
10. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Your Privacy Rights
Depending on where you live and applicable law, you may have the right to request access, correction, deletion, or a portable copy of personal information; obtain information about categories of third parties; opt out of sale, sharing, targeted advertising, or certain profiling; limit certain uses of sensitive personal information; withdraw consent; and appeal a decision concerning a privacy request. You will not be unlawfully discriminated against for exercising a privacy right.
Submit a request to marketing@kiwii.ai with the subject "Privacy Request." You may also use Privacy Choices for advertising controls. We may need to verify your request using information reasonably related to our records. Authorized agents may submit requests where permitted by law. We respond within the period required by applicable law, including 45 days where a state privacy law requires that period, and provide any legally required extension notice. A deletion request does not automatically cancel a reservation or waive a refund. We will explain any limited transaction data we must retain, its reason, and the applicable retention criteria, and delete other information as required. We will not reject an entire request solely because you have a transaction record. You may ask us to cancel a reservation and exercise privacy rights together; marketing consent is not required. For the Kiwii Move One Dollar Reservation campaign, cancellation and refund requests go to founders@kiwii.ai; the privacy-request contact remains marketing@kiwii.ai.
12. California Notice
For California residents, the categories of personal information described in Section 2, including commercial and transaction information, are collected for the purposes described in Section 4 and disclosed to the recipient categories described in Section 5. Retention criteria are described in Section 9. During the preceding 12 months, we may have disclosed identifiers and internet or device activity to advertising partners in ways that could be considered sharing for cross-context behavioral advertising. We do not sell personal information for money. Necessary payment processing is distinct from optional advertising disclosures.
If the California Consumer Privacy Act applies to us, California residents may exercise applicable rights to know, access, correct, delete, opt out of sale or sharing, limit certain uses of sensitive personal information, and receive equal service. We will not discriminate against you for exercising any of your privacy rights, such as by charging you different prices or providing a different quality of service, unless those differences are related to your information or otherwise permitted by law. Once we receive your request, we may verify it by requesting information sufficient to confirm your identity, including by asking you to verify information about your use of the Service. Regardless of whether the CCPA currently applies to us, we provide the advertising opt-out described in Section 6. California residents may also request information concerning certain disclosures for third parties' direct marketing purposes by contacting marketing@kiwii.ai.
13. Children's Privacy
The Service is intended for adults and is not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided personal information, contact us so we can take appropriate action.
14. Third-Party Services
The Service may link to third-party websites or services. Their privacy practices are governed by their own policies, and we are not responsible for their practices.
15. Changes to This Policy
We may update this Policy from time to time. We will post the revised version and update the effective or last-updated date. If required by law, we will provide additional notice or obtain consent before a material change takes effect.
